Terms and Conditions – Bacardi Legacy Offer
The Bacardi  Legacy promotion offer ("Offer") is organized by Premier Sales Promotions Pvt. Ltd., a company duly incorporated under the Companies Act, 1956, having its regd. Office at 4th Floor, Mitra Towers, 10/4 Kasturba Road, Bangalore-560001, Karnataka, India(the “Organizer”) for Bacardi India Private Limited ("Bacardi/ Company"), which is the exclusive licensee of Bacardi & Co. Ltd., who are the exclusive proprietor of the trademark 'Bacardi Legacy’.
1. Participation in the Offer is purely voluntary. There is no participation fee. To be eligible for participation in the Offer, the participant must be an individual who has completed the age of 21 years in West Bengal at the time of participation in the Offer. The Organizer will assume (and by availing this offer you warrant) that you have legal capacity to avail this offer (i.e., that you are of sufficient age and mental capacity and are otherwise entitled to be legally bound in contract). Organizer / Company shall not be held liable in the event that any persons are subsequently denied the offer as a result of any regulatory direction or applicable law. The offer is valid only at selected outlets in selected cities.
2. The Offer shall be open from 0000 hours on 18-08-2025 and close on 01-10- 2025 at 23:59 hours or until the offer stock lasts, whichever is earlier ("Offer Period"). Use of the vouchers shall not be accepted after 01-10-2025, and the same will be invalid thereafter. The Organizer / Company shall not be responsible for delayed, lost, mutilated, or corrupted vouchers. The Organizer / Company has the sole and absolute right to modify or pre-close, or extend the Offer at any time, solely at its discretion.
3. How to Participate-
a) Consumer finds a unique code and scans the unique QR on the Neck Tag on the bottle of Bacardi Legacy
b) It will take the consumer on the Offer’s landing page.
c) Consumers will be required to update their contact details, unique code, age, tick box for acceptance to terms and conditions, and receiving Offer updates.
d) Consumer will process for an OTP confirmation.
e) Once OTP is confirmed, then the consumers will have to select their preferred payment option and enter the required details, and they will receive the cashback within 24-48 business hours.
Offer limit is 01 per Mobile Number can participate 01 time during the day, 03 times during a week, and a total of 21 times during the entire Offer Period.
By accepting the Offer, Participants fully and unconditionally agree to abide by the terms and conditions, privacy policies, & Opt-in for promotional communication.
The Offer, subject to these terms and conditions, entitles the end user to a single-use Cashback voucher of Rs.200.
4. This offer is not available to employees of Organizer/Company, its clients or agencies and their immediate families.
5. This offer is not exchangeable for “cash” or otherwise or for sale. Voucher cannot be exchanged for cash or gift equivalent value. The vouchers are non-transferable. A voucher can be used only once. Validity of vouchers cannot be extended; new vouchers cannot be provided against the expired/unused vouchers.
6. Any costs associated with entering the promotion, including accessing the promotional website, are the responsibility of each entrant and Organizer / Company shall not be responsible for any cost, expense or other liability whatsoever in relation to, arising from or connected with this Offer.
7. The usage of this voucher is incumbent upon few conditions to be followed by the voucher holder. Such conditions need to be followed by the voucher holder.
8. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of Organizer / Company, including but not limited to technical difficulties, unauthorized intervention or fraud, Organizer / Company reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to invalidate any customer; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
9. Organizer / Company is not responsible for any problems or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a mobile network, or any combination thereof, or any other technical failures including any damage to entrant's or any other person's mobile handset or computer related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion.
10. If for any reason this promotion is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorized intervention, technical failures or any other causes beyond the reasonable control of which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, Organizer / Company reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion, subject to any written directions made under applicable State or Territory legislation.
11. The voucher is non-transferable, non-refundable, and cannot be used in conjunction with any other promotional offer or code.
12. Organizer / Company, its group companies, employees, agents and representatives have no responsibility/liability, financial, safety or otherwise for the use or misuse of the voucher and the order, and are not liable for any loss, cost, damage, injury or otherwise, and cannot be held responsible for any dissatisfaction, health or safety or other issue concerning use of voucher/products ordered.
13. All decisions of Company in relation to this Offer shall be final and binding upon the entrants. No correspondence or objection shall be entertained in this regard.
14. The participant shall indemnify and hold harmless Organizer and Company, and its group companies, and each of their respective affiliates, subsidiaries, directors, officers, employees, business partners, representatives and agents (the “Indemnified Parties”), from and against all claims, fines, penalties, damages, liabilities, losses, costs and expenses (including reasonable attorney’s fees and expenses) (collectively, “Losses”) incurred by or asserted against the Indemnified Parties which arise from or in connection with any actual or alleged (a) breach by instructions or guidelines or terms & conditions by participant or any act or omission, negligence, wilful misconduct or other wrongdoing of the Participant or any of their representatives. Organizer / Company disclaims any and all other liabilities of any nature whatsoever.
15. Under no circumstance the Organizer/ Company, its management, directors, employees, officers, affiliates or subsidiaries, agents, representatives, etc. shall be liable to the Participant, and/or any third party for any loss of profits or lost opportunity, or for any indirect, special, consequential, incidental, or punitive damages whatsoever, even if Organizer / Company has been advised of the possibility of any such damages. The Participant specifically agree not to file and/or initiate in person or through any family member or through any third party, any criminal and/or civil proceedings/ complaints/ applications in any courts or forum in India against Organizer/Company, its management, directors, employees, officers, affiliates or subsidiaries, agents, representatives, etc. to claim any damages for any losses or seek relief in connection with the Offer and/or the prizes. The Participant specifically agree that Organizer/Company, its affiliates, its group companies, their employees, officers, directors or any other person and/or sponsors shall not be responsible for any claims/ liabilities/ losses (including legal fees) arising out of and in relation to any injury/ damage/ harm/ loss/ death/ mental or emotional trauma suffered by the Participant in any manner whatsoever in connection with the Offer.
16. All offers are inclusive of taxes & service charges. Any deduction of applicable taxes, levies and other statutory payments, including but not limited to applicable gift tax, shall be borne solely by the consumer.
17. Any disputes arising from or in relation to this offer shall be subject exclusively to Delhi jurisdiction.
18. Participation in this offer implies acceptance of all the terms and conditions herein. Organizer / Company reserves the right to cancel or modify the offer and amend these terms and conditions at any time without prior notice.
19. All copyright and trademarks and all other intellectual property rights in the SMSs/ offer/ website and all material or content related to the offer shall remain at all times owned by Company.  All rights, title and interest including but not limited to the Intellectual Property Rights, in the current Offer material(s) and in any and all responses received shall vest solely and exclusively with Company at all times. Company or any person or entity permitted by Company in this regard shall be entitled to use the responses received or any information in connection with the entry in any media for future Offer, marketing, publicity and any other purpose without any permission and or payment to the consumer. All material submitted in connection with the Offer (whether written, audio, electronic or visual form, or a combination of those) or any photographs, video and/or film footage and/or audio recording taken of Participants are assigned to Company / Organizer upon submission and become the property of Company exclusively. Company may use the material in any medium in any reasonable manner it sees fit. Copyright in any such material remains the sole property of Company.
20. All rights, title and interest, including but not limited to Intellectual Property Rights in the Offer and/or any other promotional material(s) shall vest solely and exclusively with Company at all times. In connection with the Offer, the Company or any person or entity permitted by the Company shall be entitled to use personal details of Participant such as names, characters, photographs, voices, videotape, etc. for any media promotions, marketing activity, publicity and likewise purposes. By voluntarily participating in the Offer, Participant) hereby waive off all their rights to claim royalty, remuneration or legally challenge due to any such use of their personal details by the Organizer/ Company
